PMSI has been informed that the MSPRC has released a new version of the Rights and Responsibilities (RAR) letter on June 10, 2011. A copy of the revised RAR is available on the MSPRC website.
PMSI has noted that the most significant change to the RAR letter is the addition of language to the section entitled “Your Responsibilities as a Medicare Beneficiary.” The additional language states the following:
“If Medicare determines that it has a recovery claim, you will be provided with a demand letter, which will include applicable appeal and waiver of recovery rights. Medicare will not take any collection action during the pendency of any appeal or waiver request. (The applicable law can be found at 42 U.S.C. 1395y(b)(2)(A) & (B). )”
As stated in PMSI’s prior News Bulletin, the Demand letter for liability insurance (including self-insurance), no-fault insurance and workers’ compensation still remains under review. The MSPRC is still working cases and Demand letters will be mailed out once this review is complete.
It is recommended that clients continue to proactively request Demand letters on cases which have settled as necessary to get their cases in line for processing. The MSPRC has confirmed that once the suspension has been lifted Demand Letters will be issued on cases in the order that they were received.
